All capitalized terms not otherwise defined herein shall have the meanings ascribed to them in the General Terms.
Phrases such us “you,” “your,” and other similar expressions refer to (1) Members and visitors of the Site and (2) Sellers who are also subject to additional terms pursuant to the Trade-In Terms.
The categories of personal information we collect depend on the manner in which you use the Services and whether you are a Member, Seller, or visitor, the status of your Account (if applicable) and the requirements of applicable law.
We collect certain information you provide to us directly. For example, we collect information if you choose to sign up for Membership, fill out a form or survey, participate in a contest or promotion, subscribe to our email list, request support, submit your Product(s) via the Trade-In Program, or otherwise use our Services. The types of information we collect may include your email address, password, first name, last name, shipping address, payment information, telephone number and other information that you choose to provide ("Contact Information").
When you access or use our Services or otherwise transact business with us, we automatically collect information about you, including:
Transaction Information: We collect information about your transactions with us, including product details and the date and location of the transaction.
Device and Usage Information: We collect information about how you access and use our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type and app version. We also collect information about your activity on our Services, such as access times, pages viewed, links clicked and the page you visited before navigating to our Services.
Location Information: In accordance with your device permissions, we may collect information about the geolocation of your device. You may stop the collection of precise location information at any time (see Your Choices section below for details).
Information Collected by Cookies and Other Tracking Technologies: We, as well as third parties that provide content, advertising, or other functionality on the Services, use tracking technologies, such as cookies and web beacons, to collect information about you. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services and in our emails to help deliver cookies, count visits and understand usage and campaign effectiveness. We may also obtain information from other sources and combine that with information we collect from you, such as from identity verification services, mailing list providers, and data partners. For example, if you create or log into your Switch account through a social media website, we will have access to certain information from that website, such as your name, email address, account information and friends lists, depending on what is authorized by that social media website.
We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your location based on your IP address or infer that you are interested in certain Products based on your browsing behavior.

You may opt out of receiving marketing emails from Switch by following the instructions in those emails. If you opt out, we may still send you non-promotional emails, such as those about your account, transactions, or our ongoing business relations.
You may opt out of receiving text messages (SMS) from Switch by replying "stop" to any message.
In accordance with applicable law, you may have the right to:
Access to/Portability of Personal Data about you consistent with legal requirements. In addition, you may have the right in some cases to receive or have your electronic Personal Data transferred to another party.
Request Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information or we may refer you to the controller of your personal information who is able to make the correction.
Request Deletion of your personal information, subject to certain exceptions prescribed by law.
Request restriction of or object to processing of your personal information, including the right to opt in or opt out of the sale of your Personal Data to third parties, if applicable, where such requests are permitted by law.

The California Consumer Privacy Act or “CCPA” (Cal. Civ. Code § 1798.100 et seq.) and the Shine the Light law (Cal. Civ. Code § 1798.83) afford consumers residing in California certain rights with respect to their personal data. If you are a California resident, this section applies to you.
California Consumer Privacy Act
The CCPA requires us to disclose the following information with respect to our collection, use, and disclosure of personal data. In the preceding 12 months, we have collected the following categories of personal data: identifiers; commercial information; demographic information (note that some demographic information may be considered characteristics of protected classifications under state or federal law); internet or electronic network activity; geolocation data; audio, electronic, visual, thermal, olfactory, or similar information; inferences; and other categories of personal data that relates to or is reasonably capable of being associated with you. We collect personal data for the business or commercial purposes described in the Use of Information section above.

Switch does not sell your personal information. We do allow our advertising partners to collect certain device identifiers and electronic network activity via our Services to show ads that are targeted to your interests. To opt out of having your personal information used for targeted advertising purposes, please see the Advertising and Analytics Services Provided by Others section above.
In addition to the rights described above, subject to certain limitations, California consumers have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, and disclose, (2) request deletion of your personal information, (3) opt out of any “sales” of your personal information that may be occurring, and (4) not be discriminated against for exercising these rights. You may make these requests by emailing firstname.lastname@example.org. Monitor your email after you submit a request, as we will send you a confirmation email to verify your request. Additionally, access requests under the CCPA can be made by calling 866-5-SWITCH. We will verify your request by contacting you after receiving your request to verify your identity. Please note that we may retain certain information as required or permitted by applicable law. If you request to delete your personal data, some of our products and services may no longer be available to you.
If we receive your request from an authorized agent, we may ask for evidence that you have provided that agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. If you are an authorized agent seeking to make a request, please contact us.
Financial Incentives. We offer various financial incentives. For example, we may provide discounts, coupons, and other benefits for customers who sign up to receive our marketing emails or join certain discount programs. When you participate in a financial incentive, we collect personal information from you, such as identifiers like your name and email address and commercial information like your purchase history. You can opt into a financial incentive by following the sign-up instructions, and you have the ability to opt-out of the incentive at any time by contacting us at email@example.com or 866-5-SWITCH. In some cases, we may provide additional terms and conditions for a financial incentive, which we will provide to you when you sign up. The value of your personal information is the value of the offer or discount presented to you.
Shine the light. California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes or to opt out of such sharing. We do not share your personal data with third parties for their own direct marketing purposes.
Our retention periods for personal data are based on business needs and legal requirements. We retain personal data for as long as is necessary for the processing purpose(s) for which the data was collected, and any other permissible, related purpose. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired. When we no longer need to use your personal data, it is removed from our systems and records or anonymized so that you can no longer be identified from it.
